Terms of Service

These Terms of Service ("Terms") govern your access to and use of SMS Concierge (the "Service"), operated by SMS Concierge ("we", "us", or "our"). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility and accounts

You must be at least 16 years old (or the age of digital consent in your country, whichever is higher) to use the Service. You represent that the information you provide is accurate and that you have authority to use the phone number you register.

2. Approved phone numbers

Each Service account is tied to one or more approved phone numbers. To prevent abuse, fraud, and carrier penalties, only approved numbers may interact with the Service. We reserve the right to:

  • Verify ownership of any submitted phone number.
  • Approve, deny, suspend, or revoke approval of any number at our sole discretion.
  • Limit the number of approved numbers per account.

You may not use the Service from a number you do not lawfully control, and you may not share access to your approved number with third parties.

3. SMS usage

  • By providing your phone number and using the Service, you consent to receive SMS messages from us, including responses to your requests, account notices, and (with separate opt-in) promotional messages.
  • Standard message and data rates from your mobile carrier may apply. We are not responsible for charges from your carrier.
  • You can stop messages at any time by replying STOP. Reply HELP for assistance.
  • You agree not to use the Service to send unlawful, harassing, abusive, or excessive automated messages, or to attempt to disrupt the Service.
  • We may rate-limit, throttle, or temporarily suspend accounts that exceed reasonable usage thresholds.

4. SMS Terms

This section sets out the specific terms that apply to SMS communications with the Service.

Opt-in

You opt in to receive SMS messages from SMS Concierge by submitting your mobile phone number through our signup form on sms-concierge.com and ticking the SMS consent checkbox. By doing so, you confirm that you are the owner or authorized user of the phone number and that you agree to receive SMS messages from us. We will not send marketing SMS messages without your separate, specific opt-in.

Opt-out — STOP

You may opt out of SMS messages at any time by replying STOP (or STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT) to any SMS message we send you. After you reply STOP, we will send a single confirmation SMS and then no further messages will be sent to that number unless you opt in again. To opt back in, repeat the signup process or reply START.

Help — HELP

For assistance, reply HELP (or INFO) to any SMS message you receive from us. You will receive a reply with our identity, a brief description of the Service, and contact information for support (support@sms-concierge.com).

Message and data rates

Message and data rates may apply to each message sent to or received from SMS Concierge. These rates are determined by your mobile carrier, not by us. Check your mobile plan for details. International SMS rates may apply when you use the Service while roaming or when texting from a number outside your home country.

Message frequency

Message frequency varies based on your usage of the Service. There is no fixed cap; the volume of messages you receive depends on the volume of requests you send and on the cadence of any account or service notices.

Service availability and supported carriers

SMS delivery depends on the availability of mobile carriers and SMS gateway providers in your country. The Service is offered on an "as available" basis: we do not guarantee that every message will be delivered, that delivery will be timely, or that the Service will be available on every carrier or in every country. Carriers are not liable for delayed or undelivered messages. Some countries, carriers, or number ranges may be unsupported, and we may suspend Service to numbers in regions affected by abuse, fraud, or regulatory restrictions.

Privacy

SMS opt-in data and phone numbers are not shared with third parties for marketing purposes. See our Privacy Policy, in particular the "SMS Communications" section, for full details.

5. The Service

SMS Concierge provides on-demand information by SMS, including:

  • Turn-by-turn walking directions.
  • Local bus routes, stops, and arrival times where available.
  • Current weather conditions and forecasts (up to 10 days).

The Service relies on third-party data sources including Google Maps Platform, OpenWeatherMap, and Anthropic AI. We do not guarantee accuracy, completeness, or availability of this data.

6. Worldwide availability and limitations

The Service aims to operate worldwide, but availability and quality vary by country, carrier, and region. Some features (in particular live transit data) may be limited or unavailable in some areas. Local laws may restrict or prohibit use of the Service in certain jurisdictions; you are responsible for compliance with applicable laws in your location.

7. No emergency or safety service

The Service is not an emergency service. Do not use SMS Concierge to report emergencies, request medical assistance, or in any situation involving immediate risk to life or property. In an emergency, contact your local emergency number (e.g. 911, 112, 999).

8. Billing and subscriptions

  • Pricing, billing intervals, and included message volumes will be presented before you subscribe.
  • Subscriptions renew automatically until cancelled. You may cancel at any time; cancellation takes effect at the end of the current billing period.
  • Fees are non-refundable except where required by law.
  • We may change pricing on prospective notice (at least 30 days for paid plans).
  • You are responsible for taxes that may apply to your subscription.
  • Failure to pay may result in suspension or termination of the Service.

9. Acceptable use

You agree not to:

  • Use the Service to violate any law or third-party rights.
  • Reverse engineer, scrape, resell, or build a competing service from the Service.
  • Attempt to gain unauthorized access to the Service or other users' data.
  • Send malicious content, spam, or attempt to circumvent message limits.

10. Intellectual property

The Service, including its software, branding, and content (excluding third-party data and your own messages), is owned by us and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that directions, transit data, or weather forecasts will be accurate, complete, or current.

12. Limitation of liability

To the maximum extent permitted by law, SMS Concierge will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim arising under these Terms will not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50.

Nothing in these Terms limits liability that cannot be limited under applicable law (including, where applicable, gross negligence, willful misconduct, or death or personal injury caused by negligence).

13. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, abuse the Service, or for any other lawful reason. Upon termination, your right to use the Service ends immediately.

14. Changes to the Service or Terms

We may modify the Service or these Terms at any time. Material changes will be communicated by SMS or email. Your continued use of the Service after changes take effect constitutes acceptance.

15. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which SMS Concierge is established, without regard to conflict-of-laws principles. Disputes will be resolved in the competent courts of that jurisdiction, except where mandatory consumer-protection laws of your country grant you additional rights.
